Unanswered & Unanswerable Questions & Internal Mysteries

Take a minute or two and see if you can recall anything that puzzled you while doing research on the case.

Here's a list to start off with:

* Assuming this to be true and not a press invention ( as in Fred House supposedly saying Ali should have been put into a mental institution, but really saying that if Ali's mental health was at that point, he should be taken care of elsewhere and not in Sing Sing).....why did Inspector Byrnes blast Mary Miniter in the press...among the unpleasantries was that she lied.   Lied about what ? She gave the same description of C. Kniclo at the trial.

* Why was Eddie Fitzgerald put into The Tombs and not Sam Shine ?

* Why wasn't Kelly from the Glenmore Hotel subpoenaed to back up Miniter's testimony ?

* Why wasn't William Mannix called by the prosecution to back up Nellie English's testimony ?

* Who left the ladder in the fifth floor hallway ?

* What about the conductor on the Central Jersey Railroad line  and his story?  Why wouldn't Det. Kilcauley tell fellow cops in New York about this potential lead ?

* Did the Farmhand actually exist ?

* Was the key the actual hotel key and not fabricated by Damon ?

As well as Kelly we might ask why Tiernan wasn’t called either? Why turn down the chance of two people backing up Miniter’s ID?

Why were there no comebacks on Damon for withholding vital evidence for 10 years?

   Good one on the absence of any reaction to Damon's playing possum for 10 years....particularly from the press, if not legal circles.
On the absence of any legal reaction....it was, after all, the murder of a prostitute.  Suffice to say, had the murder occurred in 2012 and Damon come forward this year in 2022, there probably would have been a shitstorm of criticism aimed at Damon.  if not definitely would have been.  Factor in that a state Governor ( Voorhees) backed Damon up giving him a likely 'way out' of any legal trouble. 

But the absence of a press reaction raises eyebrows.  Charles Russell was alive and so was Jacob Riis.   Without being to provide dates of death of the reporters who were so outraged, I'm pretty certain most were still alive.

   Weird that the outrage displayed in some circles at the original verdict never materialized....considering the time, effort and expenses the French consulate put into the failed pardon campaigns, you'd think they'd want to know why Damon kept a low profile during the failed efforts...which is why I firmly believe Damon would have never come forward with the key or key story.  John R. Lee may have also been covering his own ass in a sense. Since it was he that opened his mouth, perhaps he thought his name would appear in the papers.  It did... but only when Damon mentioned Lee's name in the paper, effectively dragging him into the mix.

Does the functionality of the door lock to Room 31 present more of a problem more than the key in terms of a solution ?

It isn't etched in stone that being in possession of the key automatically made C. Kniclo/Danish Farmhand the murderer.

sure, in a way it does.
The key in Frank’s possession is an easy solution that he was the killer - IF the door could not lock without the key.
Not necessarily correct solution because we can still come up with scenarios where Frank simply locks the door without being the killer.

I believe the door could not lock without key.

However even if it could, there’s still: Glenmore man, Train man, Frank being in out late and sullen the day after, the bloody shirt - and his proven (by the key) presence not only at the hotel but in the very room in which the murder occurred. So he’d still be implicated and look like a decent suspect.

The conundrum is still that Ali had to have been in the room after the murder before the door was locked but without the necessary (necessary at least in my opinion) key to lock it.
